GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1. Purpose

The purpose of these general terms and conditions of sale (the T&C) apply exclusively to the online sale of J.I.K. Cosmetics (JIK COSMETICS) products on the website www.jikcosmetics.com (the Website).

The T&C govern exclusively the online sales contracts of J.I.K. COSMETICS concluded with purchasers who are consumers and constitute, together with the online order, the contractual documents opposable to the parties, to the exclusion of all other documents, prospectuses, catalogues or photographs of the Products, which have only an indicative value.

The Purchaser acknowledges that they have read these terms and conditions before placing the order, and that ordering on the Website entails the purchaser's unreserved acceptance and prior complete agreement with these T&C and warranties.

ARTICLE 2. Modification of the CGV

J.I.K. COSMETICS reserves the right to amend these T&C at any time. The T&C applicable to any order are accepted by the purchaser at the time the order is confirmed.

ARTICLE 3. Products

The Products are those shown on the Website, on the day the consumer consults the Website, subject to stock availability. The photographs illustrating the Products are not contractually binding.

ARTICLE 4. Price

The prices of the Products are shown in €. They include VAT applicable on the date of the order. J.I.K. COSMETICS reserves the right, which the consumer accepts, to amend its prices at any time, but the Products will be billed according to the base prices in force at the time the order is placed, subject to availability of the said Products.

The price of the products does not include the shipping costs charged in addition to the price.

The additional costs of transport, delivery or postage, of which the customer could be aware before the order, are fixed on the order form.

ARTICLE 5. Order

To place an order, the purchasers choose from the different Products in which they are interested and show this interest by clicking on the “Add to cart” box.

Before clicking on the “Purchase” button, the purchaser has the possibility to check the details of its order and its total price and to go back to the previous pages to correct any errors or possibly modify its order.

The confirmation of the order implies acceptance of the T&C and forms the contract.

An e-mail acknowledging receipt of the order and its payment is sent by J.I.K. COSMETICS as soon as possible. In case of an issue or error with the payment confirmation, please provide details of order at our email. support@jikcosmetics.com

Any modification of the order by the consumer after confirmation of the order is subject to the prior acceptance of J.I.K. COSMETICS.

J.I.K. COSMETICS reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of products ordered are abnormally high for purchasers having the quality of consumers.

The sales contract is formed when the consumer sends the confirmation of its order.

ARTICLE 6. Payments

The consumer can pay for purchases via Visa, Mastercard, Apple Pay or Paypal.

The site is equipped with a system of securing online payments allowing the consumer to encrypt the transmission of his banking data.

According to Article L. 221-14 of the French Consumer Code, the Purchaser is informed that the orders are with payment obligations.

ARTICLE 7. Delivery

The order will be dispatched within 30 days at the latest, with effect from the day after confirmation of the order by the Purchaser.

Products are delivered to the address indicated by the customer on the order form.

Delivery is made by Logsta SAS (service billed by J.I.K. COSMETICS).

Upon receipt of the ordered Products, the Purchaser must check that the Products are compliant. Any anomalies in delivery (missing or broken Product, damaged parcel, etc.) must be notified by the Purchaser within three business days following delivery at the latest, at the following email address: support@jikcosmetics.com or by post to the following address J.I.K. COSMETICS, 34 avenue des Champs Elysées 75008 Paris, France. The Purchaser shall return the Product(s) to J.I.K. COSMETICS at the following address J.I.K. COSMETICS, 22 rue du General Cordonnier, 92200 Neuilly sur Seine.

Any complaints made after this time limit will be rejected and J.I.K. COSMETICS will be released of all liability.

J.I.K. COSMETICS reserves the right to check the returned Product(s), examine the reason for the request and replace or not replace the Product(s) free of charge, without owing any compensation. If the ordered product is unavailable, the Purchaser will be informed. A product of equivalent quality and price may be offered to them. If the Purchaser does not accept, they may, where applicable, be refunded within thirty (30) days of their payment, at the latest. J.I.K. COSMETICS shall not be held liable in the event of failure to deliver or a delivery delay due to an event of force majeure, the action of a third party or a fault attributable to the Purchaser. In the event of a delivery delay, the Purchaser must notify this delay to the J.I.K. COSMETICS consumer services department as soon as possible, via the following email address: support@jikcosmetics.com.

ARTICLE 8. Right of withdrawal

The purchaser has a period of fourteen (14) clear days to notify J.I.K. COSMETICS of their wish to withdraw from the contract. This time limit runs from the day on which the order is received. To exercise this right of withdrawal, the purchaser must inform J.I.K. COSMETICS of their decision to withdraw from the contract by registered letter with acknowledgement of receipt at the following address J.I.K. COSMETICS, 34 avenue des Champs Elysées 75008 Paris or by emailing info@jikcosmetics.com. A draft form for the right of withdrawal is attached as Appendix 1.

The Purchaser must then return the Product(s) in its/their original packaging and in perfect state, at their own cost, within fourteen (14) days at the latest from notification of its decision to withdraw, to the following address: J.I.K. COSMETICS, 22 rue du General Cordonnier, 92200 Neuilly sur Seine. For health and safety reasons, and in accordance with Article L221-28 of the French Consumer Code, Products that have been opened by the Purchaser after delivery cannot be returned or refunded.

If the above-mentioned conditions are met, J.I.K. COSMETICS will refund the Purchaser for all the sums paid by the Purchaser, as soon as possible and within a period of fourteen (14) days at the latest from the date on which J.I.K. COSMETICS was informed of the Purchaser’s decision to withdraw. J.I.K. COSMETICS reserves the right to defer the refund until the Product(s) has been received in accordance with Article L. 221-24 of the French Consumer Code. The initial delivery charges are included, with the exception of the return charges, which are paid by the purchaser.

ARTICLE 9. Legal Warranty

All products supplied by J.I.K. COSMETICS are subject to the legal guarantee provided by articles L. 221-1 and seq. of the French Consumer Code and to the guarantee of hidden defects provided by articles 1641 and seq. of the French Civil Code.

The consumer has two (2) years to assert one or the other of these guarantees.

For the lack of conformity, the period runs from the date of delivery.

For hidden defects, the time limit runs from the discovery of the defect.

If the apparent defect, the lack of conformity or the hidden defect of the item, declared by the purchaser, if any, is proven, after expertise, J.I.K. COSMETICS undertakes to reimburse the customer at its expense and at the latest within fourteen (14) days.

J.I.K. COSMETICS shall not be held responsible for the misuse of the items by the purchaser.

ARTICLE 10. Personal Data

J.I.K. COSMETICS respects your concerns about protection of your privacy and personal data.

Your personal data will be collected and processed by J.I.K. COSMETICS. In the context of online sales, it is mandatory to enter some of your personal data, as this information is necessary for processing and delivering the orders and issuing the bills. This information is strictly confidential. Failure to enter this information will automatically lead to rejection of the order.

In accordance with the provisions of the “Informatique et Libertés” law (French Data Protection Act) of 6 January 1978, amended by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the consumer has the right of access, information, objection, correction, restriction, portability and removal of any data concerning them. The consumer also has the right to draw up and send instructions concerning the outcome of their personal data after their death and to bring a claim before a competent authority. To exercise one or more of these rights, the consumer must contact J.I.K. COSMETICS at the following email address: contact@jikcosmetics.com. All J.I.K. ARTICLE 11. Limit of liability

The liability of the J.I.K. COSMETICS cannot be committed in the event of non-performance or of bad execution of the contract due, either to the fact of the purchaser, or to the insurmountable and unforeseeable fact of a third to the contract, or to the force majeure.

Moreover, the responsibility of the J.I.K. COSMETICS cannot be engaged for non-conformity of the Product to the legislation of the country of the consumer to whom it is up to check if the product is not forbidden to the sale in its country.

ARTICLE 12. Intellectual property

J.I.K. COSMETICS, the Website, and all the elements that comprise it (such as trademarks, logos, photographs, images, illustrations, texts, slogans, videos, structure of the Website and Social Media) are the sole property of J.I.K. COSMETICS.

Any full or partial reproduction and/or representation, use, adaptation or modification of the Website or one of the elements comprising it, in any medium whatsoever and any form whatsoever, is expressly prohibited, unless previously authorised in writing by J.I.K. COSMETICS.

ARTICLE 13. Applicable law - Competent jurisdiction

Sales of J.I.K. COSMETICS products are governed by French law, regardless of the Purchaser's country of residence and the place where the Order is made. Any dispute relating to the existence, interpretation, performance or termination of the contract between J.I.K. COSMETICS and the Purchaser, even in the event of multiple defendants, will, if an amicable agreement cannot be reached, come under the sole jurisdiction of the competent French courts, pursuant to the regulations set out in the French Code of Civil Procedure.
